Terms of Service

Please read these Terms of Service ("Terms") carefully before using uptimedesk.io ("the Service") operated by UptimeDesk ("us", "we", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

UptimeDesk is a website and API uptime monitoring service. We check URLs you provide at regular intervals and notify you when they become unavailable. We also provide public status pages and reporting tools for you to share with your own clients.

2. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@uptimedesk.io if you suspect unauthorised access.

4. Acceptable Use

You agree not to use the Service to:

  • Monitor URLs you do not own or have explicit permission to monitor
  • Conduct denial-of-service attacks or stress tests against third-party services
  • Scrape, reverse-engineer, or attempt to extract source code from the Service
  • Resell or sublicense access to the Service without prior written consent
  • Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Free and Paid Plans

The Service is offered on a freemium basis. Free accounts are subject to usage limits including monitor count and check frequency as described on our pricing page. Paid plans ("Pro") are billed monthly in advance via Stripe.

We reserve the right to change plan features and pricing at any time. We will give existing paid subscribers at least 30 days written notice of any price increase.

6. Payment and Refunds

Paid subscriptions are billed monthly on the date of initial purchase. All payments are processed securely by Stripe. We do not store your payment card details.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period — you retain access to Pro features until that date. We do not offer partial refunds for unused portions of a billing period except where required by law or at our sole discretion.

If we discontinue the Service (see Section 9), we will provide prorated refunds for any unused prepaid period.

7. No Uptime Guarantee for the Service Itself

While we strive to keep UptimeDesk available at all times, we do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. Scheduled maintenance, infrastructure outages, or circumstances beyond our control may result in temporary unavailability.

UptimeDesk monitors your websites — it does not guarantee the uptime of its own infrastructure. We do not offer a Service Level Agreement (SLA) unless separately agreed in writing.

8. Limitation of Liability

To the maximum extent permitted by applicable law, UptimeDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of customers, or business interruption, arising from:

  • Your use of or inability to use the Service
  • Missed or delayed downtime alerts
  • Inaccurate monitoring results or false positives
  • Unauthorised access to your account or data
  • Discontinuation of the Service

In any case, our total liability to you shall not exceed the amount you paid us in the 30 days immediately preceding the event giving rise to the claim.

9. Discontinuation of Service

We reserve the right to discontinue the Service at any time. If we decide to shut down UptimeDesk permanently, we will:

  • Provide at least 30 days written notice to all registered users via email
  • Issue prorated refunds to all active paid subscribers for unused prepaid time
  • Provide a reasonable opportunity to export your data before closure

10. Intellectual Property

The Service, including its design, code, and content, is owned by UptimeDesk and protected by intellectual property laws. You retain ownership of any data you provide to the Service (URLs, client names, branding). You grant us a limited licence to process that data solely to provide the Service.

11. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), Resend (email delivery), and Railway (infrastructure). Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the actions or availability of third-party services.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved amicably by contacting us at support@uptimedesk.io.
